Google AdSense and the GDPR – How to be compliant

What is Google AdSense?

How Google AdSense describes their service:

Do I need a Privacy Policy if I use Google AdSense for my website or app?

Yes, you do.

If you use Google AdSense, you should add the “Google AdSense” service to your privacy policy. The Personal Data collected are Tracker, Usage Data, as stated in their Privacy Policy.

Do I need a Cookie Policy if I use Google AdSense for my website or app?

Yes, you do.

Google AdSense may install cookies on your visitors’ devices, as stated in their Privacy Policy. Therefore, you’ll need a Cookie Policy as well.

Do I need a Cookie Banner if I use Google AdSense on my website or app?

In general, websites that use third-party cookies as well as their own cookies for tracking and analytics must comply with the law and to do so are required to obtain the user’s express consent.

If you operate in the EU or could potentially have EU users, you need to comply with the Cookie Law.

Furthermore, as Google AdSense is an advertising service, you may want to consider the following:

  • If you have European users, and monetize ads on your site, be sure to pass TCF consent to your advertising partners, as failure to do so may result in reduced ad reach and negatively affect your ad revenue.   • If you have American users that could be from the state of California, you may need to comply with CPRA (CCPA amendment) requirements. A big part of this is disclosing processing that could be considered a sale under the CCPA. Another important aspect of CCPA compliance is giving your users the right to opt out.
