Subject to Investigatory and Enforcement Powers of the Federal Trade Commission (FTC)
Our organization recognizes and informs all individuals that, in our compliance with the EU-US Data Privacy Framework, we are subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC). This acknowledges our commitment to adhering to the principles set forth within the EU-US Data Privacy Framework and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) and ensures that our practices are in alignment with the requirements to protect personal data transferred from the European Union, UK and Switzerland to the United States.
Binding Arbitration Rights
Our organization wants to ensure that all individuals are fully informed about their rights under the EU-US Data Privacy Framework, including the right to invoke binding arbitration for certain disputes. If an individual believes that their personal data has been handled in a manner that is not in compliance with our privacy commitments under the EU-US Data Privacy Framework, they have the right to seek resolution through binding arbitration.
To invoke this right, an individual must first:
1. Deliver a written notice to our organization indicating their intent to pursue binding arbitration.
2. Follow the specific procedures and meet the conditions outlined in Annex I of the Data Privacy Framework Principles.
Our organization is committed to arbitrating claims in accordance with the terms set forth in Annex I of the Data Privacy Framework Principles. This process is designed to provide an individual with a means of seeking redress for any alleged non-compliance with the principles outlined in the Framework, subject to the conditions and limitations specified therein.
Please be aware that the option to invoke binding arbitration is available under certain conditions and is intended to be used as a last resort after other resolution mechanisms have been exhausted.
Binding Arbitration Option
Our organization underscores the availability of binding arbitration as a recourse for individuals under specific conditions, in accordance with the EU-US Data Privacy Framework. This option is provided to ensure individuals have a formal method to resolve disputes concerning the handling of their personal data that they believe has not been managed in adherence to our privacy commitments under the Data Privacy Framework.
To utilize this option, an individual is required to issue a written notification to our organization, expressing their intention to seek resolution through binding arbitration, and must adhere to the detailed procedures and satisfy the prerequisites as outlined in Annex I of the Data Privacy Framework Principles.
It is our obligation to engage in the arbitration of claims, abiding by the stipulations set forth in Annex I of the Data Privacy Framework Principles. This mechanism is intended to offer a structured avenue for individuals to seek redress for any presumed breaches of the principles contained within the Framework, contingent upon the fulfillment of specified conditions and limitations.
Individuals considering this route must first exhaust other available resolution mechanisms, including our internal complaint handling process and the relevant Data Protection Authority's intervention, before pursuing binding arbitration as a final resort.
Liability and Responsibilities for Onward Transfers to Third Parties
Our organization takes its responsibility to protect your personal data very seriously, including when it is transferred to third parties. In accordance with the EU-US Data Privacy Framework, we wish to inform all individuals that our organization may be held liable in cases where data transferred to a third party is processed in a manner inconsistent with the Framework's Principles, unless our organization proves that it is not responsible for the event giving rise to the damage.
Prior to any transfer of personal data to a third party, our organization requires the third party to contractually commit to providing at least the same level of data protection and privacy as required by the EU-US Data Privacy Framework, including all specific Principles and obligations contained therein. This commitment is secured through legally binding contractual agreements or by ensuring that the third party is certified under the EU-US Data Privacy Framework or an equivalent privacy framework recognized by EU authorities.
Please be aware that our organization's accountability for your data does not cease upon its transfer to a third party. Should any issues arise from the handling of personal data by a third party, individuals have the right to seek redress and may contact our organization directly for resolution.
Our dedication to the protection of personal data encompasses all stages of data handling, including onward transfers. We implement and maintain appropriate technical and organizational measures to ensure the security and confidentiality of personal data throughout its lifecycle, including encryption, access controls, regular security assessments, and staff training, in full compliance with the EU-US Data Privacy Framework.
