Il Sito è gestito, su incarico di FAZZINI, da T-DATA S.R.L. (“T-DATA S.R.L.”) che vende i prodotti a marchio “FAZZINI” commercializzati sul sito.
T-DATA S.R.L. si occupa della gestione delle vendite e delle transazioni eseguite tramite il Sito (ad esempio: gestione degli ordini, vendita e consegna dei prodotti, gestione dei resi e della garanzia legale ed altre attività necessarie alla vendita dei prodotti tramite il sito). FAZZINI fornisce i servizi che consentono l’accesso, la navigazione e la registrazione al sito. FAZZINI e T-DATA S.R.L. tratteranno i dati personali da Lei conferiti per la registrazione al sito e rispettivamente, per la conclusione del contratto di acquisto tramite il Sito quali titolari autonomi (ciascuno, un "Titolare Autonomo" e congiuntamente "Titolari Autonomi "), nel rispetto delle previsioni del Regolamento UE 679/2016 (il “Regolamento”) e del D.Lgs. 30 giugno 2003, n. 196 (il "Codice Privacy").

- FAZZINI tratterà i Suoi dati personali, in qualità di Titolare Autonomo, al fine di gestire l’accesso ai servizi del Sito e agevolare l’acquisto dei prodotti on line nonché per consentire la Sua registrazione al Sito e l’eventuale conclusione del contratto di acquisto tramite il Sito nonché, previo suo consenso, per finalità di marketing e/o profilazione;
- T-DATA S.R.L. tratterà i Suoi dati personali, in qualità di Titolare Autonomo, per consentire la conclusione del contratto di acquisto, per dare esecuzione alle obbligazioni nascenti da tale contratto, per adempiere a tutti gli obblighi di legge, compresi quelli fiscali e amministrativi, allo stesso connessi nonché per le altre finalità connesse a tale contratto e/o alla esecuzione di misure precontrattuali, come descritte nella presente informativa;

La presente informativa è resa dunque con riferimento unicamente ai trattamenti effettuati da T-DATA S.R.L. in qualità di Titolare Autonomo.

3. TRATTAMENTO DEI DATI DA PARTE DI T-DATA S.R.L. PER FINALITÀ DI CONCLUSIONE ED ESECUZIONE DEL CONTRATTO DI ACQUISTO
T-DATA S.R.L., in qualità di Titolare Autonomo, tratterà i Suoi dati personali:
- per consentire la conclusione del contratto di acquisto tramite il Sito (es: caricamento dei prodotti nel carrello e scelta della modalità di pagamento);-per dare esecuzione alle obbligazioni nascenti a carico di T-DATA S.R.L. da tale contratto, quali, a titolo esemplificativo, la consegna dei prodotti venduti;
- per consentirle l’adempimento delle obbligazioni nascenti a Suo carico dal contratto di acquisto concluso tramite il Sito, quali, a titolo esemplificativo, il pagamento on line dei prodotti acquistati;
- per dare esecuzione a misure precontrattuali da Lei richieste (es: notifica della disponibilità di un prodotto).
La base giuridica per questo trattamento è l’adempimento del contratto (art. 6.1.b) del Regolamento). Per questa finalità, T-DATA S.R.L. tratterà i Suoi dati per il tempo strettamente necessario allo svolgimento delle singole attività di trattamento (es: i dati necessari alla esecuzione del contratto di acquisto, sino alla consegna del prodotto o, in caso di mancata consegna, sino alla risoluzione del contratto), fermo restando che, scaduto tale termine, T-DATA S.R.L. potrà conservare i dati per le finalità e per i periodi massimi di conservazione di cui alle sezioni 4, 5, 6, 7, 8 e 9 della presente informativa e/o, comunque, nei casi stabiliti dal Regolamento e/o dalla legge.

Il conferimento dei dati per la finalità in oggetto è facoltativo: non esiste cioè alcun obbligo legale o contrattuale di comunicazione dei dati; essa è, tuttavia, un requisito necessario per la conclusione del contratto di acquisto tramite il Sito. La mancata comunicazione dei dati comporterà quindi l’impossibilità per l’utente di concludere tale contratto e quindi di fare acquisti tramite il Sito.
4. TRATTAMENTO DEI DATI DA PARTE DI T-DATA S.R.L. PER FINALITÀ DI ASSISTENZA/CUSTOMER CARE
T-DATA S.R.L., in qualità di Titolare Autonomo, tratterà i dati degli utenti per attività generica di assistenza e di customer care e quindi per dare riscontro alle richieste di informazioni provenienti dagli utenti ovvero per rispondere a reclami, segnalazioni e contestazioni.
La base giuridica di questo trattamento è l’esecuzione di misure precontrattuali adottate su richiesta dell’interessato (art. 6.1.b, ultimo capoverso, del Regolamento) o, a seconda dei casi, il legittimo interesse di T-DATA S.R.L. (art. 6.1.f) del Regolamento).
Costituisce interesse legittimo di T-DATA S.R.L. rispondere alle richieste di informazioni e/o alle segnalazioni e/o alle contestazioni e/o ai reclami degli utenti del sito (a cui, peraltro, T-DATA S.R.L. è tenuta a rispondere, anche in base alla normativa di cui al Codice del Consumo). Tale legittimo interesse di T-DATA S.R.L. coincide inoltre con il legittimo interesse degli stessi utenti del Sito che effettuano le richieste e/o le segnalazioni e/o le contestazioni e/o i reclami in oggetto e che, quindi, nell’ambito della relazione con T-DATA S.R.L., si può ritenere che ragionevolmente si aspettino che i loro dati personali siano utilizzati da T-DATA S.R.L. per dare loro un riscontro.

Nel caso di esercizio del diritto di opposizione al trattamento dei dati per finalità di assistenza/customer care T-DATA S.R.L. si astiene dal trattare ulteriormente i dati personali degli utenti per tale finalità, salvo che dimostri l’esistenza di motivi legittimi cogenti per procedere al trattamento che prevalgano sugli interessi e i diritti e le libertà dell’interessato oppure per l’accertamento, l’esercizio o la difesa di un diritto in sede giudiziaria.

5. TRATTAMENTO DEI DATI DA PARTE DI T-DATA S.R.L. PER FINALITÀ DI PREVENZIONE DELLE FRODI NEL CASO DI PAGAMENTO CON CARTA DI CREDITO
T-DATA S.R.L. , in qualità di Titolare Autonomo, tratterà i dati personali degli utenti al fine, nel caso di pagamento tramite carta di credito, degli acquisti effettuati sul Sito, di gestire e possibilmente bloccare le transazioni di pagamento relative a ordini fraudolenti. I dati oggetto del trattamento in questione sono i dati relativi all’ordine e i dati dell’intestatario della carta di credito usata per il pagamento, nel caso in cui T-DATA S.R.L. , al fine di garantire la sicurezza dei pagamenti, richieda all’utente copia della stessa, come indicato nelle condizioni generali di vendita che disciplinano l’acquisto. Il trattamento in oggetto non riguarda i dati riservati della carta di credito (numero della carta, data di scadenza e codice di sicurezza) che, unitamente al nome dell’intestatario della carta, sono acquisiti direttamente dal fornitore dei servizi di pagamento.
La base giuridica di questo trattamento è il legittimo interesse di T-DATA S.R.L. (art. 6.1.f) del Regolamento).
Lei ha, in ogni caso, il diritto di opporsi, in qualsiasi momento, per motivi connessi alla sua situazione personale, al trattamento dei dati personali che la riguardano per la finalità in oggetto (i.e. prevenzione delle frodi in caso di pagamento con carta di credito).

Quanto al legittimo interesse di T-DATA S.R.L., si segnala all’utente quanto segue:
- costituisce legittimo interesse di T-DATA S.R.L. svolgere un’attività, a fini di prevenzione delle frodi, nel caso di pagamento on line mediante carta di credito, a tutela del proprio interesse imprenditoriale, inclusa la finalità di rispettare i parametri definiti dai circuiti internazionali relativi al numero dei tentativi di pagamento fraudolenti rilevati sul Sito di e-commerce. Tale legittimo interesse di T-DATA S.R.L. coincide, inoltre, con il legittimo interesse degli utenti del Sito, in qualità di potenziali vittime delle frodi, che, come la collettività tutta, hanno, a loro volta, un interesse legittimo a garantire che le attività fraudolente siano scoraggiate e individuate quando si verificano; si può, quindi, ritenere che, nell’ambito della relazione con T-DATA S.R.L., essi ragionevolmente si aspettino che i loro dati siano trattati anche per finalità di prevenzione delle frodi, a loro stessa tutela e garanzia.
- il conferimento dei dati per la finalità in oggetto (i.e. finalità di prevenzione delle frodi con carta di credito) è facoltativo: non esiste cioè alcun obbligo legale o contrattuale di fornire tali dati per tale finalità; tuttavia, il mancato invio di copia della carta d’identità dell’intestatario della carta di credito con cui è stato effettuato il pagamento, qualora richiesta, comporta la risoluzione del contratto di acquisto concluso tramite il Sito.
- per la finalità in oggetto, T-DATA S.R.L. utilizza anche dati raccolti inizialmente per finalità diverse (e, segnatamente, per consentire la conclusione del contratto di acquisto e la sua esecuzione) il cui ulteriore trattamento per la finalità di prevenzione delle frodi con carta di credito è consentito, in quanto basato sull’interesse legittimo di T-DATA S.R.L., attesa la compatibilità della finalità in oggetto con la finalità per la quale i dati sono inizialmente raccolti;
- nel caso di esercizio del diritto di opposizione, T-DATA S.R.L. si astiene dal trattare ulteriormente i dati personali degli utenti per questa finalità, salvo che dimostri l’esistenza di motivi legittimi cogenti per procedere al trattamento che prevalgano sugli interessi e i diritti e le libertà dell’interessato oppure per l’accertamento, l’esercizio o la difesa di un diritto in sede giudiziaria.
6. TRATTAMENTO DEI DATI DA PARTE DI T-DATA S.R.L. PER FINALITÀ AMMINISTRATIVO-CONTABILI E FISCALI
T-DATA S.R.L. , in qualità di Titolare Autonomo, tratterà i dati degli utenti ai fini dell’esecuzione di obblighi di carattere amministrativo e/o contabile e/o fiscale, connessi al contratto di acquisto concluso tramite il Sito, quali, a titolo esemplificativo, la tenuta delle scritture contabili e l’emissione della fattura di vendita.
La base giuridica di questo trattamento è l’adempimento di obblighi di legge cui T-DATA S.R.L. è soggetta (art. 6.1.c) del Regolamento).
Il conferimento dei dati per la finalità in oggetto è obbligatorio, perché il loro trattamento è necessario per consentire a T-DATA S.R.L. di adempiere a obblighi di legge sulla stessa gravanti. L’eventuale rifiuto di conferire i dati per questa finalità comporterà l’impossibilità per l’utente di concludere il contratto di acquisto tramite il Sito. Per questa finalità, T-DATA S.R.L. tratterà i dati dell’utente sino alla scadenza dei termini di legge previsti per l’effettuazione di ciascun adempimento amministrativo-contabile e fiscale e/o per i tempi di conservazione previsti dalla legge per la conservazione della documentazione relativa.
7. TRATTAMENTO DEI DATI DA PARTE DI T-DATA S.R.L. AL FINE DI CONSENTIRE ALL’UTENTE L’ESERCIZIO DI DIRITTI
T-DATA S.R.L., in qualità di Titolare Autonomo, tratterà i dati degli utenti al fine di:
- dare riscontro alle richieste di esercizio del diritto di recesso e/o alle richieste di esercizio della garanzia legale di conformità e/o di altri diritti nascenti dal contratto di acquisto concluso tramite il Sito e/o previsti dalla legge in relazione a tale contratto;
- effettuare le attività che si rivelino necessarie quale conseguenza dell’esercizio di tali diritti e per procedere, se del caso, ai relativi rimborsi;
- ricevere e dare riscontro alle richieste di esercizio dei diritti in materia di protezione dei dati personali previsti dal Regolamento e svolgere tutte le attività conseguenti.
La base giuridica di questo trattamento è l’adempimento di obblighi di legge cui T-DATA S.R.L. è soggetta (art. 6.1.c) del Regolamento).

Il conferimento dei dati per la finalità in oggetto è obbligatorio, perché il loro trattamento è necessario per consentire a T-DATA S.R.L. di adempiere a obblighi di legge nonché all’utente di esercitare i diritti che la legge o il contratto gli attribuiscono. L’eventuale rifiuto di conferire i dati per questa finalità comporterà l’impossibilità per l’utente di esercitare tale diritti.
Per questa finalità, T-DATA S.R.L. tratterà i dati sino alla scadenza dei termini di legge previsti per l’esercizio del diritto (termine di prescrizione e/o decadenza) ovvero, nel caso di esercizio di tali diritti, per il tempo necessario alla gestione e alla chiusura della pratica; nel caso di esercizio dei diritti previsti dal Regolamento, i dati saranno trattati fino all’attestazione, da parte del Titolare del trattamento, di avere adempiuto alla richiesta ovvero fino all’adempimento stesso, a seconda di quale dei due eventi si verifichi per ultimo.
8. TRATTAMENTO DEI DATI DA PARTE DI T-DATA S.R.L. PER FINALITÀ DI ACCERTAMENTO, ESERCIZIO O DIFESA DI UN DIRITTO
T-DATA S.R.L., in qualità di Titolare Autonomo, tratterà i dati degli utenti per l’accertamento, l’esercizio o la difesa di un diritto in tutte le competenti sedi.
La base giuridica di questo trattamento è l’interesse legittimo (art. 6.1.f) del Regolamento).
Costituisce interesse legittimo del titolare del trattamento esperire mezzi di ricorso per garantire il rispetto dei suoi diritti contrattuali ovvero dimostrare di avere adempiuto agli obblighi nascenti dal contratto con l’interessato o imposti al titolare del trattamento dalla legge. Tale legittimo interesse trova, a sua volta fondamento, nel diritto alla difesa costituzionalmente tutelato. Esso può quindi ritenersi prevalente sui diritti e le libertà fondamentali dell’interessato, anche in ragione delle ragionevoli aspettative dello stesso.
L’utente ha, in ogni caso, il diritto di opporsi, in qualsiasi momento, per motivi connessi alla sua situazione personale, al trattamento dei dati personali che lo riguardano per la finalità in oggetto (i.e. difesa di un diritto/fini di giustizia).

Si segnala all’utente che, in particolare, T-DATA S.R.L. conserverà ed eventualmente utilizzerà i dati:
a) a fini di prova dell’adempimento del contratto di acquisto e/o per avviare o rispondere ad azioni relative a tale contratto davanti a qualsiasi autorità amministrativa e/o giurisdizionale e/o per tutelare i propri diritti nelle fasi propedeutiche del giudizio e/o del procedimento; per questa finalità i dati saranno conservati per 10 anni dalla consegna del prodotto ovvero dalla risoluzione del contratto, nel caso di mancata consegna del prodotto;
b) per provare di aver consentito l’esercizio dei diritti previsti dal Regolamento e/o dalla legge (es: diritto di recesso; garanzia legale) e/o dal contratto di acquisto e di aver effettuato quanto previsto dalla legge e/o dal contratto in merito (es: rimborso, nel caso di esercizio del diritto di recesso);
c) per provare di avere dato riscontro ai reclami e/o alle segnalazioni e/o alle contestazioni degli utenti;
d) nel caso di esercizio dei diritti previsti dal Regolamento, i dati saranno conservati per [5 anni a decorrere dall’attestazione di avere dato riscontro alla richiesta dell’interessato ovvero da tale riscontro, se successivo];
e) nel caso di esercizio di diritti previsti dal contratto di acquisto o dalla legge, i dati saranno conservati per [10 anni, decorrenti dalla chiusura della pratica ovvero dall’effettuazione dell’azione che la definisce] (es: rimborso, in caso di recesso; o consegna del prodotto sostitutivo, in caso di garanzia legale); per chiusura della pratica si intende l’ultima corrispondenza relativa all‘esercizio dei diritti in questione);
f) nel caso di reclami e/o segnalazioni e/o contestazioni, i dati saranno conservati per [tre anni dalla chiusura della pratica], da intendersi come ultima corrispondenza in merito.
Si segnala, inoltre, che:
- il conferimento dei dati per questa finalità è facoltativo: non esiste alcun obbligo di legge o contrattuale che imponga all’interessato di fornire i dati per questa finalità;
- per la finalità in oggetto sono utilizzati dati raccolti inizialmente per una finalità diversa, il cui trattamento ulteriore è consentito in quanto basato sul legittimo interesse del titolare, attesa la compatibilità di tale finalità ulteriore con la finalità iniziale della raccolta, tenuto conto anche del fatto che, nella misura in cui il trattamento sia necessario all’accertamento, all’esercizio e alla difesa di un diritto, il titolare del trattamento è, altresì, esentato dall’obbligo di cancellazione, per espressa previsione del Regolamento;
- nel caso di esercizio del diritto di opposizione, infatti, il titolare del trattamento si astiene dal trattare ulteriormente i dati personali, salvo che egli dimostri l’esistenza di motivi legittimi cogenti per procedere al trattamento che prevalgano sugli interessi, sui diritti e le libertà fondamentali dell’interessato oppure per l’accertamento, l’esercizio o la difesa di un diritto in sede giudiziaria.
9. CATEGORIE DI SOGGETTI A CUI T-DATA S.R.L. COMUNICA I DATI PERSONALI DELL’UTENTE (DESTINATARI)
I dati personali conferiti dall’utente possono essere comunicati da T-DATA S.R.L. alle categorie di destinatari di seguito indicate.
I soggetti a cui T-DATA S.R.L. comunica i dati agiscono in qualità di responsabili esterni del trattamento designati da T-DATA S.R.L. tramite apposito contratto (“Responsabili del Trattamento”) o di persone autorizzate al trattamento di dati personali sotto l’autorità diretta di T-DATA S.R.L. (“Incaricati”) ovvero, nel caso di terzi di cui il Responsabile del Trattamento si avvalga, in qualità di “Sub-Responsabili”, ai sensi di cui all’art. 28.4 del Regolamento, tranne nei casi in cui il destinatario agisce in qualità di titolare autonomo del trattamento, come, per esempio, nel caso del Payment Service Provider, o anche di titolare autonomo del trattamento, come nel caso dei corrieri.

I dati personali degli utenti possono essere comunicati da T-DATA S.R.L. alle seguenti categorie di destinatari:
- società del gruppo a cui T-DATA S.R.L. appartiene e/ o a dipendenti e/o collaboratori di T-DATA S.R.L., per lo svolgimento di attività di amministrazione, contabilità e supporto informatico e logistico;
- a società, consulenti o professionisti eventualmente incaricati dell’installazione, della manutenzione, dell’aggiornamento e, in generale, della gestione degli hardware e software di T-DATA S.R.L., inclusi, i fornitori dei servizi di cloud computing e di chat, e ai terzi di cui essi si avvalgano;
- a società che svolgono attività di supporto logistico e/o di magazzino e/o di confezionamento e/o di spedizione e consegna o ritiro dei prodotti acquistati sul Sito e ai terzi di cui essi si avvalgano;
- al Payment Service Provider e/o all’acquirer e/o a banche al fine di consentire il pagamento degli acquisti effettuati sul Sito ovvero il loro rimborso, se del caso e ai terzi di cui essi si avvalgano;
- a tutti quei soggetti, ivi incluse le pubbliche autorità, che hanno accesso ai dati in forza di provvedimenti normativi o amministrativi.
- a tutti quei soggetti pubblici e/o privati, persone fisiche e/o giuridiche (studi di consulenza legale, amministrativa e fiscale), qualora la comunicazione risulti necessaria o funzionale al corretto adempimento degli obblighi contrattuali assunti in relazione agli acquisti tramite il Sito nonché degli obblighi derivanti dalla legge ovvero nel caso di accertamento, esercizio o difesa di un diritto.

10. TRASFERIMENTI VERSO PAESI TERZI
I dati personali degli utenti sono trasferiti da T-DATA S.R.L., verso i seguenti paesi terzi: India.
Il destinatario di tali dati è Zoho Corporation PVL, LTD, fornitore, insieme con Zoho Corporation B.V., del servizio di chat del Sito.
Per quanto riguarda il trasferimento dei dati in India, si segnala quanto segue:
• non esiste una decisione di adeguatezza in relazione al livello di protezione dei dati garantito in India;
• in mancanza di una decisione di adeguatezza, i dati possono essere trasferiti nel paese terzo, solo se sono fornite le garanzie adeguate di cui all'art. 46.2 del Regolamento, tra cui figurano le clausole contrattuali tipo adottate dalla Commissione e/o da un'autorità di controllo nazionale;
