B METERS S.R.L., in persona del legale rappresentante pro tempore, con sede legale in 33050 Gonars (UD), Via Friuli n. 3, P.Iva 01750340307, in qualità di Titolare del Trattamento dei dati personali (in seguito anche solo il Titolare), ai sensi dell’ art. 13 del Regolamento UE n. 679/2016 (in seguito GDPR) e ai sensi del D. Lgs 196/2003 così come modificato dal D. Lgs 101/2018 (in seguito anche solo Codice Privacy) Le fornisce, nella sua qualità di Interessato, le seguenti informazioni:
la presente informativa viene resa dal Titolare rispetto ai trattamenti di dati personali dalla stessa effettuati attraverso gli appositi canali di segnalazioni delle violazioni di illeciti o irregolarità, c.d. Whistleblowing . Se la segnalazione proviene da un soggetto legato da un rapporto di lavoro o collaborazione con l’Azienda, tale informativa deve intendersi come integrativa e non sostitutiva dell’informativa resa al personale per la gestione del rapporto di lavoro.
1.0 CATEGORIA E FONTE DEI DATI TRATTATI.
Il Titolare raccoglie e/o riceve le informazioni attraverso l’inserimento delle stesse da parte del segnalante tramite la piattaforma Whistleblowing presente sul sito aziendale. La ricezione e la gestione delle segnalazioni dà luogo a trattamenti di dati personali c.d. “comuni” (nome, cognome, ruolo lavorativo, ecc.), nonché può dar luogo, a seconda del contenuto delle segnalazioni e degli atti e documenti a queste allegati, a trattamenti di dati personali c.d. “particolari” (quali per es: dati relativi a condizioni di salute, o appartenenza sindacale, di cui all’art. 9 GDPR) e/o dati giudiziari (quali per es. dati relativi a condanne penali e a reati o a connesse misure di sicurezza di cui all’art. 10 GDPR).
2.0 NATURA DEL CONFERIMENTO DEI DATI E CONSEGUENZE DEL RIFIUTO DI RISPONDERE.
Il conferimento dei dati del segnalante è obbligatorio nella “segnalazione nominativa”. Un eventuale rifiuto al conferimento dei dati nella “segnalazione nominativa” comporta l’impossibilità per il Titolare di dar seguito alla segnalazione avanzata.
Il conferimento dei dati del segnalante è invece facoltativo nella “segnalazione anonima”. Qualora la conoscenza dell’identità del segnalante fosse indispensabile per la difesa dell’incolpato, verrà domandato al segnalante se intende rilasciare un apposito, libero consenso ai fini della rivelazione della propria identità.
3.0 BASE GIURIDICA DEL TRATTAMENTO DEI DATI.
Il Titolare effettua il trattamento dei suoi dati:
per adempiere ad obblighi di legge ai sensi dell’art. 6, comma 1° lettera C (obbligo legale) del GDPR ed in particolare per la gestione del procedimento di Whistleblowing, secondo quanto previsto dal D.Lgs n. 24 del 10.3.2023 “c.d. decreto Whistleblowing” attuativo della Direttiva (UE) 2019/1937;
quanto ai dati “particolari” per assolvere agli obblighi e all’ esercizio dei diritti specifici del Titolare del trattamento e dell’Interessato in materia di diritto del lavoro (art. 9, par. 2, lett. b, GDPR);
quanto ai dati giudiziari (resosi eventualmente necessario per la gestione delle segnalazione whistleblowing ricevuta) sulla base dell’art. 10 GDPR in correlazione con l’art. 2-octies del D. Lgs. n. 196/2003;
per il legittimo interesse del Titolare ai sensi dell’art. 6, comma 1° lettera F (interesse) quale la tutela in giudizio di un suo diritto.
4.0 FINALITÀ DEL TRATTAMENTO DEI DATI.
Le informazioni personali che riguardano il Segnalante saranno trattate al fine di assicurare:
la corretta e completa gestione del procedimento di Whistleblowing in conformità alla vigente normativa in materia;
le necessarie attività istruttorie volte a verificare la fondatezza del fatto oggetto di segnalazione e l’adozione dei conseguenti provvedimenti;
la tutela in giudizio di un diritto del Titolare del trattamento;
la risposta ad una richiesta dell’Autorità giudiziaria o Autorità alla stessa assimilata.
5.0 AMBITO DI COMUNICAZIONE ED ACCESSO AI DATI.
La comunicazione dei dati personali raccolti avviene principalmente nei confronti di terzi e/o destinatari la cui attività è necessaria per l’espletamento delle attività inerenti la gestione della segnalazione, nonché per rispondere a determinati obblighi di legge.
In particolare la trasmissione potrà avvenire nei confronti di:
a) istruttore/responsabile/gestore Whistleblowing individuato dal Titolare personalmente autorizzato e previamente istruito e formato;
b) società incaricata per la gestione della piattaforma, nella sua qualità di Responsabile Esterno ai sensi e per gli effetti di cui all’art. 28 GDPR;
c) consulenti esterni (per es. studi legali) eventualmente coinvolti nella fase istruttoria della segnalazione;
d) eventuali posizioni organizzative incaricate di svolgere accertamenti sulla segnalazione nei casi in cui la loro conoscenza sia indispensabile per la comprensione dei fatti segnalati e/o per la conduzione delle relative attività di istruzione e/o trattazione; in detta ipotesi non potrà comunque essere rivelata l’identità del segnalante, pertanto verranno espunti i dati identificativi del segnalante e ogni altro elemento che possa, anche indirettamente, consentire l’identificazione dello stesso;
g) istituzioni e/o Autorità Pubbliche, Autorità Giudiziaria, Organi di Polizia, Agenzie investigative;
6.0 TRASFERIMENTO ED EVENTUALE DIFFUSIONE.
I suoi dati non saranno oggetto di trasferimento al di fuori dell’Unione Europea.

7.0 CONSERVAZIONE DEI DATI PERSONALI.
I dati verranno conservati in una forma che consenta l'identificazione degli interessati per il tempo necessario al trattamento della specifica segnalazione e comunque non oltre cinque anni a decorrere dalla data della comunicazione dell'esito finale della procedura di segnalazione.
È fatta salva la conservazione per un periodo superiore in relazione a richieste delle Autorità Pubbliche e dell’Autorità Garante per la protezione dei dati personali. È fatta inoltre salva la conservazione dei dati personali, anche particolari e/o giudiziari, per un periodo superiore, nei limiti del termine di prescrizione dei relativi diritti, in relazione ad esigenze connesse all’esercizio del diritto di difesa in caso di controversie.
8.0 DIRITTI DEGLI INTERESSATI.
Compatibilmente con le finalità ed i limiti stabiliti per il trattamento dei dati personali che ti riguardano, i diritti che ti sono riconosciuti per consentirti di avere sempre il controllo dei tuoi dati ai sensi degli art. 15 e ss del GDPR sono: a) accesso; b) rettifica; c) cancellazione; d) limitazione del trattamento; e) opposizione al trattamento; f) portabilità.
Gli interessati hanno inoltre il diritto di proporre reclamo all’Autorità Garante della protezione dei dati (www.garanteprivacy.it) qualora ritengano che il trattamento dei loro dati sia contrario alla normativa in vigore (art 77 del GDPR) o di agire in sede giudiziale (art 79 del GDPR).
Nel caso il segnalante abbia dato il consenso alla rivelazione della sua identità, ha il diritto di revocare tale consenso in qualsiasi momento, senza che però ciò pregiudichi la liceità del trattamento, basato sul consenso, effettuato prima della revoca.
Ai sensi dell’articolo 2-undecies del Codice Privacy (in attuazione dell’articolo 23 del GDPR), si informa che i summenzionati diritti non possono essere esercitati da parte dei soggetti interessati segnalati (con richiesta al Titolare ovvero con reclamo ai sensi dell’articolo 77 del GDPR) qualora dall’esercizio di tali diritti possa derivare un pregiudizio effettivo e concreto alla riservatezza dell’identità del segnalante. L’esercizio di tali diritti potranno essere esercitati dai segnalati tramite il Garante con le modalità di cui all’articolo 160 del Codice Privacy, nel qual caso il Garante informa l’interessato di aver eseguito tutte le verifiche necessarie o di aver svolto un riesame, nonché del diritto dell’interessato di proporre ricorso giurisdizionale.
L’Interessato, ferme restando le limitazioni previste dal D.Lgs n. 24 del 10.3.2023 e laddove concesso dalla normativa vigente, potrà esercitare i propri diritti mediante l’invio di una e-mail all’indirizzo privacy@bmeters.com.

B METERS S.R.L., in the person of its legal pro tempore representative, with registered office in 33050 Gonars (UD), Via Friuli no. 3, VAT number 01750340307, as Data Controller (hereinafter also only the Data Controller), in compliance with art. 13 of EU Regulation no. 679/2016 (hereinafter GDPR) and in compliance with Legislative Decree 196/2003 as amended by Legislative Decree 101/2018 (hereinafter also just Privacy Code) provides you, in your capacity as Data Subject, with the following information:
This information is provided by the Data Controller with respect to the processing of personal data carried out by the same through the appropriate channels for reporting violations, offences or irregularities, the so-called Whistleblowing. If the report comes from a person bound by an employment or collaboration relationship with the Company, this information must be understood as supplementary and not as a substitute for the information provided to personnel for the management of the employment relationship.
1.0 CATEGORY AND SOURCE OF DATA PROCESSED.
The Data Controller collects and/or receives the information added by the Whistleblower via the Whistleblowing platform on the company website. The receipt and management of reports gives rise to processing of personal data known as “common” (name, surname, job role, etc.), as well as may give rise, depending on the content of the reports and the deeds and documents attached to them, to the processing of so-called personal data. “particulars” (such as for example: data relating to health conditions, or trade union membership, referred to in art. 9 GDPR) and/or judicial data (such as for example data relating to criminal convictions and crimes or related security measures referred to in art. 10 GDPR).
2.0 NATURE OF THE PROVISION OF DATA AND CONSEQUENCES OF REFUSAL TO RESPOND.
The provision of the whistleblower’s data is mandatory in “nominative reporting”. Any refusal to provide data in the “nominative report” will make it impossible for the Data Controller to follow up on the report.
The provision of the whistleblower’s data is instead optional in “anonymous reporting”. If knowledge of the identity of the whistleblower is indispensable for the defence of the accused, the whistleblower will be asked whether they intend to give specific, free consent for the purpose of revealing their identity.
3.0 LEGAL BASIS OF DATA PROCESSING.
The Data Controller processes your data:
to fulfil legal obligations in compliance with art. 6, paragraph 1, letter C (legal obligation) of the GDPR and in particular for the management of the Whistleblowing procedure, in compliance with the provisions of Legislative Decree no. 24 of 10.3.2023 “so-called Whistleblowing decree” implementing Directive (EU) 2019/1937;
as for “special”, data to fulfill the obligations and exercise of the specific rights of the Data Controller and the Data Subject in matters of labor law (art. 9, par. 2, letter. b, GDPR);
as for judicial data (possibly necessary for the management of the whistleblowing report received) on the basis of art. 10 GDPR in correlation with art. 2-octies of Legislative Decree no. 196/2003;
for the legitimate interest of the Data Controller in compliance with art. 6, paragraph 1, letter F (interest) such as the protection of one’s right in court.
4.0 PURPOSE OF DATA PROCESSING.
Personal information concerning the Whistleblower will be processed in order to ensure:
the correct and complete management of the Whistleblowing procedure in compliance with current legislation on the matter;
the necessary investigative activities aimed at verifying the validity of the fact being reported and the adoption of the consequent measures;
the protection in court of a right of the Data Controller;
the response to a request from the judicial authority or similar authority.
5.0 SCOPE OF COMMUNICATION AND ACCESS TO DATA.
The communication of the personal data collected takes place mainly with third parties and/or recipients whose activity is necessary for the completion of activities relating to the management of the report, as well as to respond to certain legal obligations.
In particular, the communication may occur to:
a) Whistleblowing instructor/manager identified by the Owner who is personally authorised and previously instructed and trained;
b) company appointed to manage the platform, in its capacity as External Manager pursuant to and for the purposes of art. 28 GDPR;
c) external consultants (e.g. law firms) possibly involved in the investigation phase of the report;
d) any organisational positions responsible for carrying out investigations on the report in cases where their knowledge is indispensable for understanding the reported facts and/or for conducting the related education and/or processing activities; in this case, the identity of the Whistleblower cannot be revealed, therefore the identifying data of the Whistleblower and any other element that could, even indirectly, allow the identification of the same will be removed;
g) institutions and/or public authorities, judicial authorities, police bodies, investigation agencies;
6.0 TRANSFER AND POSSIBLE DISSEMINATION.
Your data will not be transferred outside the European Union.

7.0 STORAGE OF PERSONAL DATA.
The data will be stored in a form that allows the identification of the data subjects for the time necessary to process the specific report and in any case no later than five years from the date of communication of the final outcome of the reporting procedure.
This is without prejudice to retention for a longer period in relation to requests from the Public Authorities and the Guarantor Authority for the protection of personal data. Furthermore, the retention of personal data, including particular and/or judicial data, for a longer period, is reserved, within the limits of the limitation period of the relevant rights, in relation to needs related to the exercise of the right of defence in the event of disputes.
8.0 RIGHTS OF DATA SUBJECTS.
Compatibly with the purposes and limits established for the processing of personal data concerning you, the rights that enable you to always have control of your data in compliance with art. 15 et seq. of the GDPR are: a) access; b) rectification; c) erasure; d) limitation of processing; e) opposition to processing; f) portability.
Data subjects also are entitled to lodge a complaint with the Data Protection Authority (www.garanteprivacy.it) if they believe that the processing of their data is contrary to the legislation in force (art. 77 of the GDPR) or to take legal action (art 79 of the GDPR).
If the whistleblower has given consent to the disclosure of their identity, they are entitled to revoke this consent at any time, without however compromising the lawfulness of the processing, based on the consent, carried out before the revocation.
According to article 2-undecies of the Privacy Code (implementing article 23 of the GDPR), we inform you that the aforementioned rights cannot be exercised by the data subjects reported (with a request to the Data Controller or with a complaint in compliance with the article 77 of the GDPR) if the exercise of these rights may result in an effective and concrete prejudice to the confidentiality of the identity of the whistleblower. The exercise of these rights may be exercised by the persons reported through the Guarantor in the manner set out in article 160 of the Privacy Code, in which case the Guarantor informs the data subject that it has carried out all the necessary checks or has carried out a review, as well as the right of the data subject to lodge a judicial appeal.
The data subject, without prejudice to the limitations established by Legislative Decree no. 24 of 10.3.2023 and where permitted by current legislation, may exercise their rights by sending an email to privacy@bmeters.com.

- Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
- Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner.
The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to fulfil a legal obligation or upon order of an authority.
Once the retention period expires, Personal Data shall be deleted. Therefore, the right of access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.
The rights of Users based on the General Data Protection Regulation (GDPR)
Users may exercise certain rights regarding their Data processed by the Owner.
In particular, Users have the right to do the following, to the extent permitted by law:
- Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data.
- Object to processing of their Data. Users have the right to object to the processing of their Data if the processing is carried out on a legal basis other than consent.
- Access their Data. Users have the right to learn if Data is being processed by the Owner, obtain disclosure regarding certain aspects of the processing and obtain a copy of the Data undergoing processing.
- Verify and seek rectification. Users have the right to verify the accuracy of their Data and ask for it to be updated or corrected.
- Restrict the processing of their Data. Users have the right to restrict the processing of their Data. In this case, the Owner will not process their Data for any purpose other than storing it.
- Have their Personal Data deleted or otherwise removed. Users have the right to obtain the erasure of their Data from the Owner.
