Welcome to our privacy notice. The Leveque Software Company Pty Ltd, trading as Martialytics (”We” or “Martialytics”) are committed to protecting and respecting your privacy. This privacy notice will inform you as to how we look after your personal data when you visit our website (regardless of where you visit it from) and tell you about your privacy rights and how the law protects you.
This privacy notice aims to give you information on how Martialytics collects and processes your personal data and the personal of data of your children through your use of this website, including any data you or your child may provide directly through this website.
Martialytics is a software management tool for martial arts schools that enables instructors and school owners to manage their members, track student attendance, automate billing and send out communications as well as get insights about their students and classes through the use of our analytics function.
WHO IS THE PRIVACY NOTICE FOR?
This privacy notice describes the way we treat and use personal data that we collect about any martial arts school owners and instructors that use our services.
IF YOU ARE NOT AN INSTRUCTOR OR SCHOOL OWNER
We know that most of the martial arts schools that use our website have members that are under the age of 18 and therefore that child data is held on our systems. We have strong security systems in place to protect all personal data that is held on our systems and have procedures in place to make sure that is is stored safely and securely. However, we are not the Data Controllers for the purposes of the personal data that is held about the students of our instructors or schools owners. We are instead the Data Processors. This is because we will never do anything with the personal data that is held on our systems other than hold it, unless we are specifically instructed otherwise by the schools we hold it for. The martial arts school or instructors who hold data about their students on our system are the Data Controllers for the purposes of that personal data. This is because they determine the purpose for which your data is processed and the means in which it is processed. Although we ask our clients to adhere to their data privacy obligations, we strongly recommend that you read their privacy notices thoroughly so that you understand how they use, manage and handle your personal data and that of your children. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.
For the purpose of the Data Protection Act 2018 (the Act) and the EU General Data Protection Regulation (GDPR), the data processor is Martialytics by The Leveque Software Company Pty Ltd of Perth, Western Australia, Australia.

You have the right to make a complaint at any time to the Information Commissioner’s Office (ICO), the UK supervisory authority or the relevant Supervisory Authority in your jurisdiction if you are based in the EU for data protection issues. IF YOU DO NOT PROVIDE PERSONAL DATA
If we need to process the data you provide us with about yourself to fulfil our service and you fail to provide that data when requested, we may not be able to perform the service, in which case, we may have to cancel a product or service you have with us. It only includes basic personal data required for you to be able to use our site, subscribe to our service, search for a product, request support and when you report a problem with our website. The information you give us may include your full name, address, e-mail address and phone number, financial and credit card information and information that is specific to your business such as company name, address and tax information. If Martialytics or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets. If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Website Terms and Conditions and other agreements; or to protect the rights, property, or safety of Martialytics, our customers, or others. WHERE DO WE STORE YOUR INFORMATION?
For the purposes of IT hosting and maintenance this information is located on servers outside the European Economic Area, in Sydney, Australia using Amazon Web Services, Inc (AWS).
Some of our external third parties such as Google, Rocket Science Group and Xero are based outside the European Economic Area (EEA) so their processing of your personal data will involve a transfer of data outside the EEA.
All personal data we process is processed by our staff in the UK and also Australia which is outside the EEA.
Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission Where we use certain service providers and staff, we may use specific contracts approved by the European Commission which give personal data the same protection it has in Europe. Where we use providers based in the US, we may transfer data to them if they are part of the Privacy Shield which requires them to provide similar protection to personal data shared between the Europe and the US. Once we have received your information, we have a Data Protection regime in place to oversee the effective and secure processing of your personal data and we will use strict procedures and security features to try to prevent unauthorised access.
However and unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our website at transmission stage; any transmission is at your own risk.
HOW LONG DO WE KEEP YOUR INFORMATION FOR?
We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn.
